Committee recommendation
That Council approve that 320 Tweedsmuir Avenue be
exempted from the requirements set out in the Demolition Control By-law to
enable the demolition to proceed as soon as possible to address the hazardous
state of the property.

That Planning
and Environment Committee recommend Council approve that 320 Tweedsmuir
Avenue be exempted from the requirements set out in the Demolition Control
By-law to enable the demolition to proceed as soon as possible to address the
hazardous state of the property.
Pursuant to Section 77 (12) of the Procedure By-law, Councillor Leadman requested that the following motion be placed on the Planning and Environment Committee Agenda:
WHEREAS
demolitions of residential dwelling units, located in the former City of
Ottawa, are subject to the Demolition Control process as set out in the former
City of Ottawa Demolition Control By-law;
AND
WHEREAS staff are in the process of revising the by-law, which includes a
recommendation to exempt single dwelling units located in a residentially zoned
area from the requirement to submit to the Demolition Control process, as it
has been found to hinder development and renewal of residential neighbourhoods;
AND
WHEREAS a residential dwelling unit located at 320 Tweedsmuir Avenue in the
Kitchissippi Ward 15 has been vacant since 2002 or so and is in such a state of
disrepair that it constitutes a hazard and the proposed cost of remediation
would exceed the building’s value;
AND
WHEREAS the building must be demolished pursuant to an Order prior to the onset
of winter conditions and the building is not of heritage interest;
BE IT RESOLVED THAT 320 Tweedsmuir Avenue be exempted from the requirements set out in the Demolition Control By-law to enable the demolition to proceed as soon as possible to address the hazardous state of the property.
Legal Services and Planning and Growth Management are aware of this motion and are in support.
The Chief Building Official has declared the building unsafe and was consulted in the preparation of this report. The exemption is required in order to proceed with the demolition of the unsafe building.
This item will be advertised in the local dailies as part of the Public Meeting Advertisement on Friday preceding the Planning and Environment Committee meeting.
DISPOSITION
City Clerk’s Branch, Council and Committee Services to notify the owner, John Brian Johnston, (58 Roxborough Street West, Toronto ON M5R 1T8) and the ward councillor of Council’s decision.
